Adam Reynolds, 33, appeared at the Horsham Magistrates’ Court on November 5.
Horsham police prosecutor Senior Constable Michelle Wentworth told the court that Reynolds had damaged a plasterboard door after a verbal argument with his family on March 11 at a Horsham address.
Senior Constable Wentworth said Reynolds was asked to leave and pushed over his brother’s motorbike.
“The brother came around a corner with a tent pole and hit Reynolds over the head. The accused was taken to hospital at 8.20pm,” she said.
Senior Constable Wentworth said police spoke to Reynolds after his mother reported the encounter.
“Police spoke with accused. He had staples in his head and was needing a cat scan,” she said. “He said he actions were out of frustration. The last thing he could remember was his brother with a metal tent pole.”
Reynolds was arrested on March 24 and released pending summons.
Reynold’s lawyer told the court that the argument was about Reynold’s trying to get his brother a job, but he as not receptive to the idea. She said the motorcycle was pushed in hate as he was trying to leave.
“(Reynolds) is willing to pay for a replacement plasterboard door,” she said.
The defence reminded the court that Reynolds was also a victim.
Magistrate Ronald Saines released Reynolds on a 12-month good behaviour bond. He will also donate $500 to the court, which would be used to address family violence and its consequences.
“This is an example of domestic violence. It quickly became an act of aggression and violence in the heat of the moment, It’s not a classic example, but nevertheless,” he said.
Magistrate Saines said Reynolds’ brother’s actions should equally be condemn.
