A HORSHAM man who attempted to steal from Kmart twice has been sentenced to three days in jail.

Benjamin Spitalar, 39, appeared in Horsham Magistrates' Court on Monday, where he pleaded guilty to theft.
The court heard that Spitalar entered Kmart in the Horsham Plaza on August 19 at 6.23pm.
He placed a Bluetooth speaker, worth $29, down his pants and attempted to leave the store.
However, as he tried to leave, the store's security alarm went off and a security guard confronted him.
Spitalar was arrested and later told police he was stoned.
A week later, on August 26, Spitalar went to Kmart again and put a head-torch, worth $5, into his pocket.
A witness saw him and called triple-0. Police arrived and arrested Spitalar.
Spitalar's actions were also captured on CCTV.
Defence lawyer Simon Torpy said the thefts were opportunistic and Spitalar had no money.
"By his own admission, it was a stupid thing to do," he said.
Mr Torpy said Spitalar had substance abuse issues and had been using morphine, ice and cannabis.
Magistrate Therese McCarthy told Spitalar that he couldn't go into shops and take things that didn't belong to him.
She sentenced him to three days in jail, which has already been served.
